1. The Purchaser(s) who is /are Malaysian Citizen(s) must be:

    • Above the age of eighteen (18) and not declared a bankrupt by the Official Assignee;
    • Legally incorporated entity in Malaysia and no petition for winding up made against the Purchaser(s) or declared wound-up.
  1. Transfer of booking/ sale of the Property is not permitted and is not assignable and transferable as it is exclusive to the Purchaser(s) only.

  1. The solicitor stated in Section 1 of Schedule A attached shall attend to the following:

    • the Sale and Purchase Agreement and Deed of Mutual Covenants (if applicable) (both Sale and Purchase Agreement including the Deed of Mutual Covenants are collectively referred to as "Sale Documents");
    • the Financing Documents with the panel end-financiers.

    • However, in the event you choose to appoint your own solicitor for any or part of the above matters, all expenses pertaining to the purchase and financing of the Property are to be borne by you solely and absolutely.

  1. The sale of the Property and your eligibility to enjoy the waiver of the earnest deposit alongside Section 3 of Schedule A attached is subject to you strictly complying with the following conditions:

    • To complete a CCRIS check on the day of booking and provide us with complete documentation within three (3) working days from the date of this Property Form. Complete documentation includes but is not limited to, 6 months latest pay slips, 6 months bank statement, latest EPF statement, EA form/ BE form/ B form, and photocopies of identification cards; and
    • To apply for a loan ("the Loan") within three (3) working days from the date of this Property Form to assist you to complete your purchase of the Property from any one of the end-financiers only as stated in Section 2 of Schedule A attached; and
    • You shall execute the Sale Documents with us within fourteen (14) working days from the date of this Property Form; and
    • You shall forward to us a copy of the duly accepted Letter of Offer from any of the above panel end-financiers stated in Section 2 of Schedule attached evidencing their approval and your acceptance of the Loan within fourteen (14) working days from the date of this Property Form, and
    • If additional documents are requested by any of the above panel of end-financiers stated in Section 2 of Schedule attached to obtain loan approval, you are obliged to take further action and provide these within an additional three (3) working days, failing which the booking will be deemed cancelled ; and
    • Initial payment which is 10% of the purchase price is payable upon your acceptance of loan or upon execution of sale documents.
    • To execute the Financing Documents within fourteen (14) days from the date of notification from the appointed solicitors requesting you to execute the Financing Documents and your confirmation/ undertaking to comply with the approval terms of the Loan from the end-financier.

    • failing which, we shall be entitled to forfeit the deposit / earnest deposit paid in full and it shall be deemed that you are no longer interested in the purchase of the Property and we reserve the right to rescind this Letter and thereafter we shall be entitled to deal with the Property in any manner we deem fit without further reference or notice to you.

  1. Once you have complied with and satisfied Clause 4 above, we shall bear and pay the items set out in Section 3 of Schedule A attached, PROVIDED that:

    • The Loan is granted by any one of the panel end-financier as stated in Section 2 of Schedule A attached; and
    • All the documentation for Sale Documents AND the Financing Documents for your Loan shall be attended to by the solicitor as stated in Section 1 of Schedule A attached.

  2. The deposit and/or earnest deposit will only be refunded to the Purchaser(s) upon production of documentary proof from the Financial Institution that the Purchaser(s) loan application has/ have been rejected and we shall entitle to charge an administration fees of Fifty Ringgit (RM 50.00)

  1. In the event prior to the full payment of the Purchase Price of the Property,

    • you are in default of the Sale and Purchase Agreement and/ or the Sale and Purchase Agreement is terminated for any reason whatsoever;
    • you dispose the Property to third party;
    • you refinance the Loan with another end financier;
    • you are in default under the Financing Documents; and
    • you fail to comply with any terms and conditions stated herein;
    • All the documentation for Sale Documents AND the Financing Documents for your Loan shall be attended to by the solicitor as stated in Section 1 of Schedule A attached.

    • then we shall be entitled not to pay for and bear the Items set out in Section 3 of Schedule A attached by giving you a seven (7) days written notice to the effect. Upon the expiry of the notice period therein, you shall reimburse all payment made by us pursuant to Clause 6, failing which interest at the rate of ten per centum (10%) per annum calculated on the amount owing from the due date till the date of full payment made by you shall be charged.
  1. All information contained in the sales brochures and the presentation of show units/houses are subject to change as may be required by the relevant authorities or developer's architect and without notification to you and shall not taken as the identical representation of the actual unit that is to be or being purchased by you or part of an offer or contract. Please refer to the Sale and Purchase Agreement of the actual unit for specification and description approved by the authorities and the actual unit shall be constructed accordingly.

  1. Notwithstanding the acceptance of Initial Payment by us, you unconditionally agree that for all intents and purposes, the effectiveness of the Sale Documents shall be the date of the Sale Documents particularly in respect of the time of delivery of vacant possession.
